Nanny Terms and Conditions
DEFINITIONS
In these Terms and Conditions the following expressions shall have the following meanings:
"The Applicant" means the person introduced by the Agency to the Client for an Engagement.
"Client" means the person; firm or corporate body together with any subsidiary or associated Company as defined by the Companies Act 1985 in which the Applicant is introduced.
"Agency" means A Perfect Balance Limited of 43 Bath Place, Chilbolton Avenue, Winchester, Hampshire, SO22 5HH
"Engagement" means the engagement, employment or use of the Applicant by the Client or any third party on a permanent or temporary basis.
Terms and conditions set out below constitute an agreement between The Agency and The Applicant.
1. The complete and partial invalidity or unenforceability by any competent authority of any provision herein for any purpose shall in no way affect the validity or enforceability of such provision for any other purpose of the remaining provisions.
2. The Applicant agrees to relate to The Agency a full history of their previous employment and qualifications.
3. The Applicant agrees to notify the Agency immediately of any offer of an Engagement made by a Client of the Agency.
4. The Applicant agrees to supply The Agency with the names of 2 or more referees.
5. The Applicant agrees to inform The Agency immediately of any change in their circumstances relating to the Engagement.
6. The Applicant agrees to attend any interview arranged, and if unable to attend will provide at least 24 hours notice to the prospective employer.
7. The Applicant gives consent for the Agency to advertise their availability and position sought by any available media.
8. The Applicant gives consent to The Agency to contact them by e-mail if any positions become available.
9. The Agency will supply prospective Clients with the Applicants CV, reference and other documentation.
10. The Agency shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Applicant arising from or in any way connected with the Agency supplying the Client.
11. The Agency accepts no liability for any act or omission of any Client introduced by the Agency even if such act or omission is negligent or fraudulent or reveals any dishonesty.
12. The Applicant agrees that any information relating to the Agency's Client (s) is confidential. No such information should be passed on whether verbally or in written form to any other third party unless with the written consent of the Agency.
13. An Applicant cannot accept details of the same vacancy from another nanny agency, reply to an advert on other sites or respond to a local press advert if The Agency has already advised the applicant of the position by telephone or email. If this occurs the Applicant will be removed from the agency's files immediately. |
